Financial Goals Facebook Photo Contest
Official Contest Rules and Regulations
NO PURCHASE NECESSARY
The “Financial Goals Facebook Photo Contest” (the “Contest”) is sponsored by Manulife Bank, located at 500 King Street North, Waterloo, Ontario N2J 4C6 Canada (the “Sponsor”).
To enter and be eligible to win, a person must be a legal resident of Canada, and over the age of majority in the province or territory where they reside (the “Entrant”). This contest is not open to the residents of Quebec.
Employees or agents of Manulife or Manulife Bank, or their affiliates, subsidiaries, dealers and distributors, advertising affiliates, promotion agencies, and any persons who are members of those employees’ immediate families, are not eligible to participate in the Contest. Potential winners may be required to furnish proof of identification in the form of government issued identification.
2. Contest period
The Contest begins at 7:30 a.m. EST Friday November 1, 2019 and will end at 9:00 p.m. EST Friday November 22, 2019 (the “Contest Period”).
3. How to enter
No purchase necessary to enter or win.
1. A maximum of one (1) entry per person is permitted. All eligible individuals who participate in the contest by posting a photo with a comment as described below, during the Contest Period will be automatically entered into the contest. Each post will be considered a single entry for purposes of the contest.
To enter the contest, you must:
a. Have a Facebook account;
b. Follow Manulife Bank on Facebook;
c. Post a photo to Manulife Bank’s Facebook page, along with a short description of how Manulife Bank helped you achieve a financial goal.
d. Conform, as applicable, to Facebook requirements; and
2. All submitted entries must meet the following criteria:
a. The photo must be original and taken solely by you; modifying someone else’s work is not considered an original photo for the purposes of this contest.
b. It must not violate the rights of any third party. For example, your photo must not violate the copyrights of another party or defame, infringe or violate publicity or privacy rights of any person, living or deceased, or contain disparaging images or remarks about the Sponsor or its products.
c. Your photo must not contain trademarks, logos or trade dress owned by anyone other than the Sponsor or advertise or promote any brand or product of any kind.
d. Your photo cannot have been published, used commercially, submitted to another competition or contest, or won any other award.
e. Your photo must be in good taste and in keeping with the Sponsor’s image as determined by the Sponsor, in their sole and absolute discretion.
Online access is required to participate in this contest. Many public libraries, retail businesses and others offer free access to computers and Internet service.
If you don’t already have a Facebook Account, you can create one for free by going to www.facebook.com. By submitting your information and creating an Account, you will be required to agree to Facebook’s Terms of Service and Data Policy. If you do not agree to Facebook’s policies, you cannot create an Account and may not be able to participate in this Contest.
By entering the Contest, Entrants agree to accept and abide by the provisions of these Rules, Facebook’s Promotion Guidelines, and the decisions of the Sponsor, whose decisions shall be final and binding.
4. Judging the winners
A panel of judges from the Sponsor will review all the entries and choose three (3) winners whose entries best reflect the benefits of Manulife Bank products and services and verify the contest eligibility of each submission.
The winning entries will be announced on Facebook on November 29, 2019. The winners will be contacted by direct message through Facebook. If, after making such efforts as The Sponsor in its sole discretion deems reasonable, a winner cannot be contacted through direct message within two (2) business days of November 22, 2019, or if the Sponsor determines a winner is ineligible to win a prize, that photo entry will be disqualified, and a new winner will be selected from the remaining eligible contest entries.
Once contacted, the winners will be required to correctly answer, unaided, a time-limited mathematical skill-testing question, to be administered by the Sponsor. If the skill-testing question is not answered correctly, a new potential winner will be selected from the remaining eligible contest entries. This process will repeat until a potential winner, who has complied with these rules, is successfully contacted and correctly answers the skill-testing question – thereby deeming them a contest winner.
The contest winners agree to sign the Sponsor’s standard declaration and release form confirming compliance with the rules and regulations. If a contest winner is determined to be ineligible by the Sponsor, or fails to return the completed declaration and releases as required within 2 days of notification, the Sponsor may declare the prize to be forfeited and a new winner may be selected and contacted in accordance of these rules, which process will repeat until a new winner is declared who complies with all rules and conditions of this contest.
8. Prizes and odds of winning
The contest winners will receive cash prizes (“the prizes”) of:
- First place: $500
- Second place: $300
- Third place: $200
The winners will qualify to win the prizes, provided they comply with these rules. There is one prize to be awarded to each winner. Prizes must be accepted as awarded and are non-assignable, non-transferable, and have no cash surrender value.
The value of the prize is taxable as income where required by law. Prize winner is solely responsible for any and all expenses, taxes, fees, and applicable federal, provincial and local taxes relating to the prize.
Odds of winning depend on the total number of entries received.
By entering the Contest and voluntarily providing certain personal information required by the entry form, Entrants consent to the collection, use and disclosure by the Sponsor of the Entrant’s information to administer this Contest and for purposes outlined in the Sponsor’s privacy policies.
Acceptance of the prize by a winner constitutes permission for the Sponsor to use a winner’s name, photographs, photograph description, prize won, statements made relating to the Contest, and other likeness of the winner for any and all promotional or business purposes without further compensation, except where prohibited by law.
The Contest is subject to all applicable federal, provincial and local laws. VOID WHERE PROHIBITED BY LAW.
The Contest and these Rules shall be governed by and construed under Ontario law, without regard to conflict of laws principles. All Entrants expressly agree that any claims relating to this contest must be resolved in the Province of Ontario, and hereby waive the jurisdiction of any other court that now or in the future could be considered competent for any reason.
11. Limitation of liability
By participating, each Entrant agrees that the Sponsor, their affiliates, subsidiaries, dealers and distributors, advertising affiliates and promotion agencies, officers, directors, employees and shareholders (“Sponsor Entities”) are not responsible for any incorrect or inaccurate entry information, human error, failures, omissions or for anything, including but not limited to, the errors in advertising, these Rules, the selection and announcement of winners or distribution of any prizes, resulting from the participation in this Contest.
By accepting a prize, the winner releases the Sponsor and the Sponsor Entities from any and all liability and responsibility with respect to the prize (including, without limitation, any property loss, damage, personal injury, death, rights of publicity or privacy, defamation, whether intentional or unintentional) arising out of or in connection with the receipt, ownership, or use of a prize.
Subject to applicable law, the Sponsor reserves the right to amend, cancel, terminate or suspend the Contest (in whole or in part) if for any reason the Contest cannot be run as planned, including but not limited to: an error, technical problem, computer virus, bug, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, or the odds of winning, without providing any prior notice.
In the event that it is discovered that an Entrant has entered more than once during the Contest Period using a different Account and/or email address, he/she will be disqualified, and respective eligible prize claim will become null and void and the Entrant will not be entitled to claim any prize. In the event of a dispute regarding the identity of an Entrant, the entry will be deemed made by the authorized account holder of the Account submitted at the time of entry (i.e. the person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail address, that is linked to the Account). Should it be discovered that an Entrant is using the aid of computer programs to complete entries, that Entrant will be disqualified from the Contest; and Sponsor reserves the right to disqualify all such entrants from future contests conducted by Sponsor without further notice. The selected entrant may be required to provide proof that he/she is the authorized account holder associated with the selected on-line entry.
All entries become the property of the Sponsor. No communication will take place with Entrants, except the Entrant(s) selected as the potential winners.
Any attempt by an Entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Participation engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned or used under licence by the Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
